Transfer Exclusive Rights of Burial - deceased owner

If the current owner of the Exclusive Rights of Burial has died, the plot becomes part of the estate of the deceased. Depending on whether or not the deceased left a valid Will, you may need to provide the documents as set out below. The document will need to be the be original copies bearing the seal of the issuing authority. All documentation will be returned.

If the deceased owner left a valid Will

Grant of Probate:

  • If the Grant of Probate was obtained then you can register ownership in the name of executor by providing the Grant of Probate certificate
  • If the Grant of Probate was not obtained then you will need to provide the Statutory Declaration document signed under oath to confirm the details in the Will

If the deceased owner did not leave a valid Will

Grant of Letters of Administration:

  • If the Grant of Letters of Administration was obtained then you can register ownership in the name of Administrator by providing the Grant of Letters of Administration document
  • If the Grant of Letters of Administration was not obtained then you will need to provide a Statutory Declaration document to confirm the details of the transfer to those entitled to receive the transfer

Original documents

You will need to complete the online form and also, as part of completing the process, you must send the original documents to:

If you use the online form and send the original documents to the above address, the Council will seek to process the transfer within 14 days. If there is an issue, the Council will contact you with any further requirements.

Transfer process

You can complete the Council's online form at the bottom of this page. The Borough of Broxbourne Cemeteries team is specially trained to deal with bereavement. You will need to provide:

  • your contact details
  • details regarding the deceased and your relationship to them
  • the grave number
  • details of the deed and when it was purchased
  • details of the registered owner
  • a death certificate
  • details of the executor or executrix
  • a probate certificate, grant of letters or statutory declaration (see above)
